CPAP NOW offers a selection of new CPAP pumps, masks and parts to all postcode locations within Australia. Please review the warranty information listed on the specific product page for more information, as these products may have varying warranty periods and/or terms.

By using the services we have provided you on the website http://www.CPAPNOW.com.au, you are agreeing to the following terms with CPAPNOW.com.au.

Prior to use of CPAPNOW.com.au website and services, you must accept all of the terms and conditions in this User Agreement. This agreement applies to any of CPAP NOW (referred to throughout this document as CPAPNOW.COM.AU or CPAP NOW) domains and sub-domains. This Agreement is effective 30/1/2019.

1. ORDERING & PAYMENT TERMS

Advertised prices are in Australian Dollars and are for upfront purchasing by way of payment options on checkout. Finance options may not be available with these prices due to the high cost of offering a payment plan service. Prices on this website exclude shipping and handling. Terms of payment are at cpapnow.com.au sole discretion, and unless otherwise agreed to in writing by cpapnow.com.au, payment must be received before cpap.com.au can accept your order. Invoice amounts are due and payable upon checkout. CPAP NOW may invoice parts of an order separately.

2. RETURN POLICY

Right to Cancel

All customers have the right to cancel their orders under the Distance Selling Regulations which gives consumers extra protection when buying online. We will meet our obligation under the relevant State Legislation to provide a remedy if the goods are defective. We are not obligated to provide a refund if you change your mind about the purchase of CPAP products.

Your order is considered accepted once you have placed the order and provided payment information. There will be a 5% cancellation fee for any orders placed that are cancelled before it ships out. Banks charge a processing fee on all transactions, therefore a fee applies for any cancellation. Orders cancelled within 24 hours may be eligible for no cancellation fee if the credit card company has not yet processed the payment.

If you are in possession of the goods, you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the contract.

Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you after receipt of the returned product.

We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at your expense.

Making a Return

CPAP NOW will accept non faulty, unused product returns for purchases made through CPAPNOW.com.au on unopened product(s) within 14 days of the date of purchase (not delivery).

@ 03 7019 3144  to arrange for an approved return number. You will need to provide the invoice number, item description and serial number (where applicable) of the product(s) you wish to return.

Approved return items must be received by CPAP NOW within 14 days the return number is issued, in order to be valid for return consideration. A restocking fee of 25% will be subtracted from the original charges and a refund will only be issued for the amount of the items on the sale and will not include shipping costs, accessories or merchant fees charged to CPAP NOW.

CPAP NOW will not accept returns on products that have been opened. We recommend that you take precautionary measures to ensure you are purchasing the best suited equipment and products for your needs.

Warranty Items

CPAP NOW will accept returns on products you purchase that have manufacturing defects. Please contact us first for troubleshooting. CPAP NOW will exchange your product for the same item or an item of equal value at no additional charge. Approved return items must be received by CPAP NOW within 14 days of the return number issue, in order to be valid for warranty consideration. CPAP NOW does offer extended warranty plans on certain items.

Please note that any associated shipping cost to return products to CPAP NOW is not covered for any warranty or return circumstance.

IMPORTANT INFORMATION

Product lines vary from manufacturer to manufacturer and your mask sizes may differ. Example: A medium mask size for one style may be a large for another. Take precautionary measures to ensure you are purchasing the right style and size mask.

We do consider all machines used if opened and if usage hours are placed on the machine. CPAP and BI-Level/Bi-PAP warranty decisions for repair or replacement are made solely by the manufacturer.

All Machines (CPAP, Bi-Level, Bi-PAP, VPAP Adapt SV, Bi-PAP AutoSV, AutoPAP etc.,) which are experiencing functional issues and are no longer under manufacturer warranty, may be repaired by the manufacturer. This policy varies by manufacturer. A diagnostic fee (which varies and is determined by the manufacturer), which may or may not be applied to the actual repair cost (depending on the manufacturer) will be collected prior to submitting the machine to the manufacturer for assessment.

4. USE OF OUR SITE

While using the services and website of CPAP NOW you are prohibited/restricted from:

  • Registering or using any email address that you do not own or for which you do not have the express permission of the owner to register with.
  • Duplicating, changing, or disseminating content and our copyrights and trademarks; gathering, compiling, or in any way collecting information about users, including email addresses, without first obtaining such user’s express consent.
  • Posting inappropriate content, violating any laws, third party rights or any of our policies.
  • Using CPAP NOW, if you are below the age of 18, if you are unable to form legally binding contracts.
  • Manipulating the list price of any product, service or item listed on the website www.cpapnow.com.au
  • Posting false, inaccurate, misleading, defamatory, or libellous content (including personal information)
  • Distributing or posting, emailing or otherwise transmitting any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, or pyramid schemes.
  • Impersonating any person or entity, including without limitation a cpapnow.com.au employee or agent, or otherwise misrepresent your affiliation with any person or entity.

CPAP NOW has the right to suspend, deactivate, limit, or cancel our service and user accounts, impede or restrict access to our website at our own discretion. CPAP NOW reserves the right to refuse service to anyone. We may, at our sole discretion, label or categorize any customer or user account “Refuse to Provide Service”. Should this occur, we will continue to provide warranty and other related services as required by law, however we will not sell any further products to the “Refuse to Provide Service” customer.

5. MEDICAL ADVICE

You recognize and agree the content made available through cpapnow.com.au is for information only and is not intended to be taken and should not in any way be construed as medical advice or counselling or as the practice of medicine. Users should never use any CPAP NOW resources in place of seeking professional advice. We make no guarantees, promises, or predictions of success regarding any of the services or resources offered through CPAP NOW.

6. MAILING LIST

By placing an order you agree to be included on our mailing list. You can unsubscribe at any time by clicking the ‘unsubscribe’ link within any promotional email list you receive.

7. RELEASE

You agree to release CPAP NOW, trustees, officers, agents, directors, subsidiaries, joint ventures and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, real or imaginary, arising out of or in any way connected to a dispute with CPAP NOW.

8. TYPOGRAPHICAL ERRORS

In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, CPAP NOW shall have the right to refuse or cancel any orders placed for the product or service listed at the incorrect price. We also have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, CPAP NOW shall issue a credit to your credit card account in the amount of the incorrect price. CPAP NOW attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content on this site is accurate, complete, reliable, current, or free of errors.

9. RISK OF LOSS

All items purchased are made pursuant to a shipment agreement. This means the risk of loss and title for such items pass to you upon our delivery to the carriers (Auspost).

10. HEALTH INSURANCE INFORMATION

CPAP NOW are not a provider for any insurance company or health care organization. CPAP NOW sells sleep apnea related equipment to customers by credit charge/paypal. We are a private pay site. We do not work with private or government based insurers or social benefit programs. CPAP NOW is not a Medicare provider nor do we have a Medicare contract to provide services. Medicare will not reimburse you for purchases you made through CPAP NOW.
